Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Trade Mongo website and platform (the "Service"), operated by Big Market 360 Private Limited, F211, Express Zone Commercial Hub, B wing, Malad East, Mumbai-400063, India. By using the Service, you agree to these Terms.

1. Definitions

• "Company", "we", "us" — Big Market 360 Private Limited.
• "User", "you" — any person or business accessing the Service.
• "Buyer" — a User who uses the Service to source products or services.
• "Supplier" — a User who lists a business, product, or service on the Service.
• "Content" — text, images, documents, and other material submitted to the Service by Users.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract in the jurisdiction from which you access the Service. If you are using the Service on behalf of a business, you represent that you are authorised to bind that business.

3. Accounts

You are responsible for the accuracy of information you provide, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

4. The Service

Trade Mongo is a marketplace that connects Buyers and Suppliers. We are not a party to any transaction between a Buyer and a Supplier. We do not manufacture, warehouse, ship, invoice, or collect payment for goods or services listed on the Service. Our role is limited to hosting the platform, providing verification, and facilitating discovery.

5. Content and licence

You retain ownership of Content you submit. By submitting Content, you grant the Company a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that Content solely to operate and improve the Service.

You are solely responsible for your Content. You warrant that your Content does not infringe any third party's rights, violate any law, or breach any obligation of confidentiality.

6. Acceptable use

You must not use the Service to:

• post false, misleading, or fraudulent information (including inflated GSTINs, fake certifications, or misrepresented products);
• infringe intellectual property rights, publicity rights, or privacy rights of any person;
• transmit malware, scrape data at scale, or interfere with the operation of the Service;
• solicit off-platform payments to circumvent buyer protection or fees;
• engage in harassment, threats, or unlawful discrimination.

Violation of this section may result in account suspension, termination, and — where the conduct is unlawful — referral to law enforcement.

7. Fees

Access to the Service is free for Buyers. Suppliers may access certain paid features under the plans described on the Pricing page. Fees are payable in advance and are non-refundable except as set out in our Refund policy.

8. Verification is not a guarantee

We verify Suppliers to reduce fraud risk (see How verification works). Verification is a diligence step, not a warranty of product quality, delivery, or contractual performance. You must exercise your own commercial judgement in every transaction.

9. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. To the extent permitted by applicable law, the Company's aggregate liability arising out of or relating to the Service is limited to the fees you paid to the Company in the 12 months preceding the event giving rise to the claim, or ₹5,000, whichever is greater.

10. Indemnity

You agree to indemnify the Company against any claim, loss, or liability arising out of your Content, your use of the Service in breach of these Terms, or your transactions with other Users.

11. Termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law. You may close your account at any time from the dashboard.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email at least 15 days before they take effect. The version and effective date at the top of this page always reflect the currently binding text.
